ARTICLE 1 – ACCEPTANCE

Customer acknowledge knowing when ordering, particular sales conditions expressed here and accept them unreservedly. These present sales conditions rule contractual relationships between EZNOV and its customer. These rules apply to ordering conditions, payment, deliveries and returns management.

These conditions apply to every new products and services sold via www.neuronflybarless.com, and come into force from signature or purchase order validation, which equals signature.

ARTICLE 2 – PRODUCTS

Pictures and texts describing products are not part of the contractual field. If errors occur, it cannot involve EZNOV liability. Furthermore, customer still is in a position to contact us to get complementary information about displayed products, via our contact form on www.neuronflybarless.com website.

Products availability indicated on this website is only indicative. If an exceptional and temporary stock shortage, in particular due to our suppliers, the customer will be advised shortly and could cancel his order. The customer could ask for a refund in 30 days maximum or swap for another product.

ARTICLE 3 – ORDER

Every order must be done via www.neuronflybarless.com.

An acknowledgment of receipt confirming your order will be send automatically to you, via e-mail.

EZNOV reserve itself right to cancel every order from clients with whom a dispute exists about a former order.

Every info given by the buyer when ordering involve him, EZNOV will not be held responsible for consequences happening in case of errors related to addressee’s/debtor’s wrong address and phone number.

ARTICLE 4 – PAYMENT

Overview:

Product’s price is due cash purchase in Euros, the day the order is passed. Once order is validated by the customer it’s considered as effective once the bank payment center gives its approval. In case of refusal, order will be cancelled.

Items stay EZNOV property until full payment.

Online payment:

  • Credit Card:
    Client bank info (credit card number and expiry date) are encrypted by SSL system, then processed by our bank partner PAYBOX SYSTEM. Buy from EZNOV is then totally safe.
  • Bank transfer:
    You can choose this way of payment on cart page, Bank info you need to transfer money to us will be displayed. Order process starts once we receive full payment. After 10 days, without receiving your payment, order will be cancelled.

Other ways:

  • Check or postal order (only France):
    Items ordered are reserved and put in preparation when check is processed by the bank. This way of payment is only accepted for order less than 200€, and only for a first order. Our services reserve themselves the right to ask a payment via bank transfer. Thanks for sending us a check to EZNOV to pay the full price (including taxes and postage) and labelling back with order number and your ID number.

Once we receive it, it will be processed by our services.Your order will only be processed once we receive full payment. After 10 days, without receiving your payment, order will be cancelled.

ARTICLE 5 – PRICE AND INVOICE

Prices displayed in your confirmation order by EZNOV include items prices in Euros but don’t included postage. These prices can be modified at any time, without notice. For European Union countries, our services are sold including tax (GST) applicable the day the order is validated. For other countries, sales exclude tax (GST) and invoices are printed by EZNOV and joined to orders.

ARTICLE 6 – DELIVERY

The delivery time depends on the availability of products in your order. An order can be shipped when all selected products are displayed “in stock”. If one of them is not indicated in stock, the customer will have to consider an additional delivery time.

Calculated shipping is done on the basis of a single shipment. However, if the customer wants a partial shipment of the order, he will have to request it and pay an extra for postage and packing.

The delivery of our products is possible in all countries served by our partner. Orders are delivered directly to the specified address provided by the customer on his order. We cannot be held responsible for any errors or late delivery in the event of incomplete or inaccurate information. We cannot be held responsible for any late delivery or failed attempt to deliver in case of absence, the carrier will leave a calling card in the customer’s mailbox inviting him to contact him later to reorganize the delivery of the parcel, or collect it to the nearest post office.

In the unlikely event that you receive goods which were not what you ordered or which are damaged or defective, please follow our returns procedure by contacting EZNOV by email.

If the package shows obvious signs of opening or impacts, you must reject it and draw up a damage report, with the carrier, you’ll send it back to us to proceed to repayment or exchange. If these procedures are not followed, EZNOV will not be liable for any charges incurred in returning the goods to EZNOV.  

ARTICLE 7 – RIGHT TO CANCEL – UNWANTED ITEMS

You may cancel the contract at any time but no later than 7 working days after the day you received the product by sending the notice of cancellation by email ensuring that you quote your name, address and order reference number. Please follow our right to withdraw procedure by contacting EZNOV by email. We will provide you with a right to withdraw number along with details on how and where to send your item. Wrap the item securely and include the original invoice along with your right to withdraw number. You must ensure that the goods are packed adequately to protect against damage. If you fail to take care of the goods before they are returned to us, and this results in damage or deterioration, we will not refund you.

You will be liable for any charges incurred in returning the goods to EZNOV or if you fail to return goods you will be liable for any charges incurred in relation to attempt to collect the goods.

Protection of goods in case of return:
EZNOV provides the best care to protect and packaging his products.
In case of return of goods, customer must applied the same care, in order to avoid any damages.
If EZNOV find and demonstrate that returned item is damaged, it can’t be refunded.

ARTICLE 8 – WARRANTY

NEURON comes with a 12 month warranty against manufacturing defects. Guarantee does not cover cables and accessories. To arrange service for products under warranty please email us. We will provide you with a return number along with details on how and where to send your item. Wrap the item securely and include the original invoice along with your return number. You must ensure that the goods are packaged adequately to protect against damage. If you fail to take care of the goods before they are returned to us, and this results in damage or deterioration, we will not refund you.
Warranty will not be longer applicable if you technically intervene on products. These manipulations concerns opening casing, solder or un-solder any/several component(s): part(s) or all of it.
You will be liable for any charges incurred in returning the goods to EZNOV or if you fail to return goods you will be liable for any charges incurred in relation to attempt to collect the goods.

ARTICLE 9 – LIMIT OF LIABILITY

EZNOV does not guarantee the safety of operation or use of products sold on its website. It is the responsibility of each user solely to obtain and wear safety equipment as needed and assure the safety of others around them when using and operating the NEURON.

EZNOV do not manufacture electronic components used in the NEURON, only the manufacturer liability could be involved for personal injury, property damage or in case of fire.

ARTICLE 10 – LEGISLATION AND JURISDICTION

Any dispute occurring after or because this present contract will be submitted to the competent arbitration centre. If mediation fails, disputes are matter of Tribunal de Commerce de METZ, France (Commercial Court of METZ, France), where EZNOV headquarters are located.

Contractual info presented in French and displayed for sale are in accordance with French law. Client and user outside our borders, we advise you to check with local authorities, possibilities and ways products you contemplate to order, should be used according to your local rules. EZNOV could not be held responsible if you fail to respect a foreign country legislation.

ARTICLE 11 – BANK DATA AND ID CONFIDENTIALITY

www.neuronflybarless.com website, represented by EZNOV, involve its liability to protect your personal data and your private life.

EZNOV, owner of www.neuronflybarless.com, and PAYBOX SYSTEM (RCS Versailles B 431 408 608) to secure online transactions via credit card, are the only addressees of your payment data required to order. PAYBOX SYSTEM is liable for processing these data by computer and defines transactions analyse level and works against bank fraud.

If you fail to give these data, transection cannot be processed.

In case of and outstanding payment for credit card fraud will result in registration of names, addresses and phone numbers related to this order to the competent default of payment register, operated by PAYBOX SYSTEM. An irregular statement or anomaly could also be processed particularly.

Furthermore, to satisfy fiscal and legislation obligations, each invoice will be kept 10 years by EZNOV.

According to the French law “Informatique et Libertés” dated from January 6th, 1978, you have, at any time, the right to access, modify and correct your personal data by writing to
